New LMIA Rules in Canada Are Now in Effect


Canada has introduced key updates to the Labour Market Impact Assessment process, impacting low-wage applications under the Temporary Foreign Worker Program starting April 1, 2026.

The most important federal changes include a longer advertising period of at least 8 consecutive weeks and a new requirement for employers to actively target youth during recruitment. In addition, temporary rural measures may apply in certain provinces and territories between April 1, 2026, and March 31, 2027.

8-Week Advertising Requirement

From April 1, 2026, employers must advertise low-wage positions for a minimum of 8 consecutive weeks within the 3 months before submitting an LMIA application. At least one recruitment method must remain active until a final decision is issued.

This replaces the previous 4-week requirement, meaning employers need to start hiring efforts earlier and maintain detailed records of all advertising activities.

Low-Wage vs High-Wage LMIA

LMIA classification depends on whether the offered wage meets the provincial or territorial threshold:

  • Below the threshold: low-wage stream applies
  • At or above the threshold: high-wage stream applies

High-wage positions generally still require 4 weeks of advertising. The new 8-week rule applies only to low-wage roles.

Youth Recruitment Requirement

Employers must now show clear efforts to recruit young Canadians. This includes using platforms and programs that specifically reach job seekers under 30.

Accepted methods include:

  • Posting on Job Bank’s youth section
  • Advertising on youth-focused job boards
  • Partnering with schools, colleges, or training institutes
  • Participating in youth employment programs
  • Using social media channels popular with younger audiences

Employers must keep proof of these efforts for up to 6 years.

Ongoing Employer Requirements

Low-wage employers must still:

  • Post jobs on Job Bank unless exempt
  • Use at least two additional recruitment methods
  • Keep records of all hiring activities for 6 years
  • Enable and review applications through Direct Apply
  • Respond to applications within 21 days

Ignoring applications or disabling required features may result in non-compliance.

Temporary Rural Measures

To support employers in smaller communities, temporary measures are in place from April 1, 2026, to March 31, 2027.

Eligible rural employers may:

  • Retain a higher proportion of temporary foreign workers if already above limits
  • Access an increased cap of 15 percent instead of the standard 10 percent

These measures apply only in participating regions and require confirmation that the job location falls outside major urban areas.

Application Timeline

With the new rules, planning is critical:

  • Weeks 1–8: Run continuous job advertising
  • Weeks 1–2: Begin youth-focused recruitment
  • Ongoing: Review applications within 21 days
  • Weeks 8–12: Prepare documentation
  • Week 12+: Submit LMIA application

The application fee remains $1,000 per position.

Compliance and Penalties

Authorities can inspect employers for up to 6 years. Non-compliance can lead to:

  • Fines of up to $100,000 per violation
  • LMIA revocation
  • Temporary or permanent bans from the program

Providing false information can result in serious penalties.

LMIA-Exempt Alternatives

Employers may consider LMIA-exempt options under the International Mobility Program. These include:

  • Intra-company transfers
  • Trade agreement pathways such as CUSMA

These alternatives can simplify hiring where eligibility applies.
